The Right To Privacy In Malta
It is known that in the legal system of Malta, human rights provisions enshrined in the Constitution of Malta. It is important to pay attention to the right to privacy. This right has been recognized in the basic instruments relating to the human rights, such as the Universal Declaration of Human Rights 1948 and the European Convention on Human Rights and Fundamental Freedoms 1953. It states that nobody can be subjected to the procedure connected with a personal search or a search of his property, or the penetration of other persons in its own premises. No other position can be considered as that which violates this article to the extent that the law provides for a norm that is necessary.
For example, in the interests of defense, public safety, order, morality and health, to contribute to the promotion of the public good, or to promote the rights and freedoms of others to such an extent as is reasonably justifiable in a democratic society. These and others positions were fixed on the fifth session UN in Geneva, which took place on 4-15 May 2009 (UN, 2009).
For many years, in addition to the provisions of the Constitution, the Government of Malta put forward various legislative initiatives aimed at strengthening the guarantees, and the implementation of individual human rights. In particular, this applies to the legislation on protection from discrimination, vulnerable persons, the rights to privacy and protection of workers’ rights.
Malta – is a democratic country, which advocates for the protection of the right to privacy of its citizens. The Maltese traditionally active in the UN, OSCE and Council of Europe. Malta is actively cooperating with organizations and takes part in the signing of the Conventions relating to the protection of human rights. This state is the model for all democratic states.
